1. Introduction
Welcome to Seauton (“the App,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Seauton mobile and web applications, services, and related content (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. Seauton provides tools designed to support mental growth, self-reflection, and emotional awareness. Users can record or write their thoughts and may receive AI-generated feedback.
1.1. Medical and Mental Health Disclaimer Seauton is an AI-powered personal growth and journaling tool. It is not a medical or therapeutic application. The insights and analyses generated by the AI do not constitute a medical diagnosis, professional psychological advice, or a treatment plan.
By using the Service, you acknowledge and agree that:
Seauton is not a licensed medical provider and does not replace professional mental health care or therapy.
The Service is intended for self-reflection and personal development only.
CRITICAL SAFETY WARNING: In the event of a mental health crisis, or if you are experiencing thoughts of self-harm or suicide, you must not rely on this application. You should immediately contact professional emergency services, a doctor, or a suicide prevention hotline in your country.
Your use of the Service is entirely at your own risk.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using Seauton, you represent that you meet this requirement and have the authority to enter into these Terms.
3. Account Registration and Security
You may access the Service by signing in with your Google account or Sign in with Apple. You agree to provide accurate and complete information during registration and to maintain the security of your account credentials. You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate any account that violates these Terms or engages in suspicious, fraudulent, or harmful activity.
4. Use of the Service
You agree to use Seauton only for lawful purposes and in accordance with these Terms. You may not: Use the Service in a manner that violates any applicable law or regulation; Upload, post, or transmit content that is abusive, defamatory, or otherwise harmful; Attempt to gain unauthorized access to the Service or related systems; Use automated scripts or bots to interact with the Service. Seauton may modify or discontinue parts of the Service at any time, with or without notice.
5. Content and Intellectual Property
All intellectual property rights in the Service, including but not limited to design, text, graphics, logos, and underlying software, are owned by or licensed to Seauton. You retain ownership of the thoughts, notes, and recordings you create using the Service (“User Content”). By submitting User Content, you grant Seauton a limited, non-exclusive, and revocable license to store, process, and analyze such content solely for the purpose of providing the Service and improving its functionality. You are solely responsible for your User Content and for ensuring it does not infringe on the rights of others.
6. Data and Privacy
Your privacy and data protection are governed by the Seauton Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and processing of information as described in that policy.
7. Subscription and Payment
Access to the full functionality of Seauton requires an active paid subscription. Subscriptions are billed on a monthly or annual basis through the Apple App Store or Google Play Store, depending on your device and platform.
Subscriptions automatically renew unless you cancel your subscription at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your App Store or Play Store account settings. Deleting the app does not cancel your subscription.
All payments are processed and managed by the respective app store. Seauton does not directly collect or store any payment information. The billing, renewal, and refund policies of the applicable app store apply to all payments made through their platforms.
A 7-day free trial is provided for monthly subscriptions, and a 14-day free trial is provided for annual subscriptions.
Right of withdrawal (EU/EEA consumers): Under EU consumer law, you generally have the right to withdraw from a digital service contract within 14 days of purchase. By starting to use the Service immediately after purchase (including during a free trial that converts into a paid subscription), you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the Service has been fully provided. You may still cancel future renewals at any time through your App Store or Play Store account settings.
All payments are non-refundable, except where required by applicable consumer protection law or by the respective store's own refund policy.
If a payment cannot be processed (for example, due to insufficient funds or billing issues), access to premium features may be suspended until the subscription is renewed successfully.
Seauton reserves the right to change subscription prices in the future. Users will be notified of any price adjustments in accordance with the policies of the relevant app store and applicable law.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. Seauton does not guarantee that the Service will be uninterrupted, error-free, secure, or meet your expectations.
To the maximum extent permitted by law, Seauton disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, Seauton shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Service. Seauton’s total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid for using the Service in the 12 months preceding the claim (or USD 0 if the Service was free).
10. Termination
You may terminate your account and stop using the Service at any time by deleting your account through the app settings or by contacting us at seauton.team@gmail.com. Upon account deletion, all your personal data will be removed in accordance with the Privacy Policy.
Seauton reserves the right to suspend or terminate your access to the Service, with or without notice, if you breach these Terms, engage in fraudulent or harmful activity, or if required by law. Upon termination, your right to use the Service ceases immediately, but provisions of these Terms that by their nature should survive termination (such as limitation of liability, intellectual property, and governing law) will remain in effect.
11. Changes to These Terms
Seauton reserves the right to modify these Terms at any time. Updates will be posted with a new "Last Updated" date at the top of this document. If we make material changes that significantly affect your rights or obligations, we will notify you in advance through the app or by email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and may delete your account.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without prejudice to the mandatory consumer protection rights granted to you under the laws of your country of residence within the European Union or European Economic Area.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If no resolution is reached, the dispute shall be subject to the jurisdiction of the competent Polish courts, except where mandatory law gives consumers the right to bring proceedings in their country of residence.
Online Dispute Resolution (EU consumers): The European Commission provides an online platform for the resolution of disputes between consumers and traders, available at https://ec.europa.eu/consumers/odr.
